Deze algemene voorwaarden (“Voorwaarden”) zijn van toepassing op uw toegang tot en gebruik van de website www.alorahair.nl, de “Website” en op de aankoop van producten via deze Website. Deze Voorwaarden gelden voor klanten in Nederland en België, en in andere landen waarnaar wij leveren, zoals aangegeven op de Website. Door een bestelling te plaatsen of de Website te gebruiken, gaat u akkoord met deze Voorwaarden. Als u niet akkoord gaat, verzoeken wij u de Website niet te gebruiken.

Wij verkopen aan consumenten in Nederland, België en andere landen vermeld op de Website. Voor grensoverschrijdende verkoop binnen de EU wordt btw geheven en afgedragen volgens de EU One Stop Shop (OSS)-regeling.
2. Definities
• “Wij”, “ons”, “onze” verwijst naar Alora Hair.
• “U”, “klant” verwijst naar de persoon die een bestelling plaatst of de Website gebruikt.
• “Producten” verwijst naar de goederen die te koop worden aangeboden op de Website.
• “Bestelling” verwijst naar een verzoek tot aankoop van Producten via de Website.
3. Toepasselijkheid
Deze Voorwaarden zijn van toepassing op elk aanbod dat wij doen en op elke Bestelling en overeenkomst tussen u en ons, tenzij wij schriftelijk uitdrukkelijk anders zijn overeengekomen.
4. Bestellingen en totstandkoming van de overeenkomst
• Een bestelling via de Website geldt als een aanbod tot aankoop van Producten.
• De overeenkomst tussen u en ons komt tot stand zodra wij de bestelling per e-mail of op een andere schriftelijke wijze bevestigen.
• Wij behouden ons het recht voor een bestelling te weigeren of te annuleren, bijvoorbeeld bij vermoeden van fraude, fouten in prijzen of productinformatie, of als producten niet op voorraad zijn.
• U bent verantwoordelijk voor het verstrekken van juiste en volledige gegevens (naam, adres, betaalgegevens) bij het plaatsen van een bestelling.
5. Prijzen en betaling
• Alle prijzen op de Website zijn in euro (EUR) en inclusief geldende btw, tenzij anders vermeld.
• Verzendkosten, indien van toepassing, worden afzonderlijk weergegeven tijdens het bestelproces voordat u de bestelling afrondt.
• Wij behouden ons het recht voor prijzen te wijzigen, maar wijzigingen hebben geen invloed op reeds bevestigde bestellingen.
• Betaling dient volledig te worden verricht op het moment van bestellen, via een van de bij het afrekenen aangeboden betaalmethoden (bijvoorbeeld iDEAL, creditcard of andere methoden via onze betaalprovider).
• Indien betaling niet wordt ontvangen of wordt afgewezen, hebben wij het recht de bestelling te annuleren of op te schorten.
6. Levering
• Wij streven ernaar Producten te leveren binnen de op de Website of in de orderbevestiging vermelde termijn. Genoemde levertijden zijn indicatief en geen bindende termijnen, tenzij expliciet anders overeengekomen.
• Het risico van verlies of schade aan Producten gaat over op u bij levering.
• Bij vertraging in de levering informeren wij u zo snel als redelijkerwijs mogelijk is.
• Wij leveren momenteel naar de volgende landen/regio's: Nederland/Belgie.
7. Herroepingsrecht (retourneren)
Als u een consument bent en als particulier binnen de Europese Unie koopt, geldt het volgende op grond van Europese en Nederlandse/Belgische consumentenwetgeving:
• U heeft het recht de overeenkomst binnen 14 kalenderdagen na ontvangst van uw bestelling te herroepen, zonder opgave van redenen.
• Om dit recht uit te oefenen, dient u ons vóór het verstrijken van de termijn van 14 dagen te informeren over uw beslissing tot herroeping door middel van een duidelijke verklaring (bijvoorbeeld per e-mail naar alorahairnl@outlook.com.
• U dient de Producten zonder onnodige vertraging en in elk geval binnen 14 dagen na uw melding van herroeping aan ons terug te zenden, in de oorspronkelijke staat waar redelijkerwijs mogelijk.
• Wij vergoeden alle van u ontvangen betalingen, inclusief standaard verzendkosten, binnen 14 dagen na ontvangst van de geretourneerde Producten of bewijs van verzending, via dezelfde betaalmethode als de oorspronkelijke transactie.
• De directe kosten van het terugzenden van de Producten zijn voor uw rekening, tenzij anders vermeld.
• Het herroepingsrecht geldt niet voor bepaalde producten zoals wettelijk bepaald, bijvoorbeeld op maat gemaakte of gepersonaliseerde artikelen, verzegelde goederen die om gezondheids- of hygiëneredenen niet kunnen worden teruggezonden na opening, en digitale inhoud die met uw instemming direct is geleverd.
8. Garantie en conformiteit
• Wij garanderen dat Producten voldoen aan de overeenkomst, de op de Website vermelde specificaties en de toepasselijke wettelijke vereisten op het moment van levering.
• Wettelijke garantierechten onder Nederlands en Belgisch/EU-consumentenrecht zijn van toepassing naast eventuele door ons aangeboden garantie.
• Indien een Product defect is of niet aan de overeenkomst voldoet, neem dan zo snel mogelijk contact met ons op via alorahairnl@outlook.com, met een beschrijving van het probleem.
9. Aansprakelijkheid
• Onze aansprakelijkheid voor schade is beperkt tot het bedrag dat is betaald voor het Product waarop de claim betrekking heeft, behalve in geval van opzet of grove nalatigheid onzerzijds.
• Wij zijn niet aansprakelijk voor indirecte schade of gevolgschade, waaronder winstderving of gegevensverlies.
• Niets in deze Voorwaarden beperkt aansprakelijkheid die volgens Nederlands of Belgisch/EU-recht niet kan worden beperkt of uitgesloten (zoals aansprakelijkheid voor overlijden of persoonlijk letsel door onze nalatigheid).
10. Intellectueel eigendom
Alle inhoud op de Website, waaronder tekst, afbeeldingen, logo's en ontwerpen, is ons eigendom of aan ons in licentie gegeven en wordt beschermd door intellectuele-eigendomsrecht. Het is niet toegestaan inhoud van de Website te kopiëren, te reproduceren of te verspreiden zonder onze voorafgaande schriftelijke toestemming.
11. Privacy
Wij verwerken persoonsgegevens in overeenstemming met ons privacybeleid, beschikbaar via [link naar privacybeleid], dat voldoet aan de Algemene Verordening Gegevensbescherming (AVG/GDPR).
12. Klachten en geschillenbeslechting
Indien u een klacht heeft over een Product of onze dienstverlening, neem dan contact met ons op via alorahairnl@outlook.com. Wij streven ernaar binnen 3 werkdagen te reageren.
Indien wij uw klacht niet rechtstreeks kunnen oplossen, kunt u deze ook indienen via het Online Dispute Resolution-platform van de Europese Commissie op ec.europa.eu/consumers/odr.
• Klanten in Nederland kunnen ook contact opnemen met Stichting WebwinkelKeur of de Geschillencommissie, indien van toepassing op ons lidmaatschap.
• Klanten in België kunnen ook contact opnemen met de Consumentenombudsdienst (Algemene Consumentengeschillencommissie) of de FOD Economie.
13. Overmacht
Wij zijn niet aansprakelijk voor het niet of vertraagd nakomen van verplichtingen door omstandigheden buiten onze redelijke controle, waaronder natuurrampen, stakingen, transportstoringen of tekortkomingen van leveranciers.
14. Wijzigingen van deze Voorwaarden
Wij kunnen deze Voorwaarden van tijd tot tijd wijzigen. De versie die gepubliceerd is op de Website op het moment van uw bestelling is van toepassing op die bestelling. Wij raden aan deze Voorwaarden periodiek te raadplegen.
15. Toepasselijk recht en bevoegde rechter
Op deze Voorwaarden is Nederlands recht van toepassing. Geschillen die voortvloeien uit of verband houden met deze Voorwaarden of een overeenkomst tussen u en ons worden voorgelegd aan de bevoegde rechter in Nederland.
Indien u een consument bent die in België (of een ander EU-land) woont, ontneemt deze rechtskeuze u niet de bescherming die wordt geboden door dwingende bepalingen van het recht van uw land van verblijf, voor zover van toepassing onder EU-regels inzake consumentenbescherming (waaronder Verordening (EG) nr. 593/2008, “Rome I”). Dit betekent dat bepaalde dwingende Belgische consumentenbeschermingsregels mogelijk nog steeds van toepassing zijn op uw aankoop, ongeacht het hierboven genoemde toepasselijke recht.

These Terms and Conditions (“Terms”) govern your access to and use of the website [jouwwebsite.nl] (the “Website”) and the purchase of products through it. These Terms apply to customers located in the Netherlands and Belgium, as well as other countries we ship to, as indicated on the Website. By placing an order or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

4. Orders and Conclusion of Agreement

5. Prices and Payment

• The direct cost of returning the Products is borne by you, unless stated otherwise.
• The right of withdrawal does not apply to certain products as provided by law, for example custom-made or personalized items, sealed goods that are not suitable for return for health or hygiene reasons once unsealed, and digital content supplied immediately with your consent.
8. Warranty and Conformity
• We warrant that Products comply with the agreement, the specifications stated on the Website, and applicable legal requirements at the time of delivery.
• Statutory warranty rights under Dutch and Belgian/EU consumer law apply in addition to any warranty we may offer.

15. Governing Law and Jurisdiction
These Terms are governed by the laws of the Netherlands. Any disputes arising from or in connection with these Terms or any agreement between you and us will be submitted to the competent court in the Netherlands.
If you are a consumer residing in Belgium (or another EU country), this choice of law does not deprive you of the protection granted by mandatory provisions of the law of your country of residence, where applicable under EU rules on consumer protection (including Regulation (EC) No 593/2008, “Rome I”). This means that certain mandatory Belgian consumer protection rules may still apply to your purchase, regardless of the governing law stated above.
